By accessing and using Serkit ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Serkit is a workout tracking and fitness management application that allows you to create custom workout routines, track your exercises, and monitor your fitness progress. The Service is provided by Serkit, based in New Zealand.

3. User Accounts

You may use Serkit without creating an account. If you choose to create an account for features such as cross-device sync, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Content and Data Ownership

You retain full ownership of all content you create within the Service, including workout routines, exercise logs, and personal fitness data. We do not claim any ownership rights over your content. By using the Service, you grant us a limited license to store and process your content solely to provide the Service to you.

5. Free and Paid Services

Serkit offers a free tier with core features and a Pro subscription with additional capabilities. Free tier limitations and Pro features are detailed on our Pricing page. Subscriptions are billed monthly in New Zealand Dollars (NZD). You may cancel your subscription at any time, and access will continue until the end of your billing period.

6. Coaching Features

Pro subscribers may use coaching features to share routines and view workout data of clients who have accepted their invitation. Coaches are responsible for maintaining appropriate professional relationships with their clients. Clients can disconnect from a coach at any time.

7. Health and Safety Disclaimer

Important: Serkit is a fitness tracking tool and does not provide medical advice, diagnosis, or treatment. The AI Coach feature provides guidance based on your workout history but is not a substitute for professional medical advice. Always consult a qualified healthcare professional before beginning any exercise program. You assume all risks associated with your use of the Service and your fitness activities.

The Service, including its design, features, and content (excluding user-generated content), is owned by Serkit and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

10. Termination

We may terminate or suspend your access to the Service at our discretion if you violate these Terms or engage in conduct harmful to other users or the Service. You may delete your account at any time through the app settings. Upon termination, your right to use the Service ceases immediately.

11. Limitation of Liability

To the maximum extent permitted by law, Serkit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

You agree to indemnify and hold harmless Serkit from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
