1. Acceptance of Terms

By accessing and using Serkit ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Serkit is a workout tracking and fitness management application that allows you to create custom workout routines, schedule your training, track your exercises, and monitor your fitness progress. The Service is provided by Serkit, based in New Zealand.

Serkit stores your data on your device so the Service works without an internet connection. Creating an account is optional and enables synchronisation across your devices.

3. User Accounts

You may use Serkit without creating an account. If you choose to create an account for features such as cross-device sync, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. User Content and Data Ownership

You retain full ownership of all content you create within the Service, including workout routines, exercise logs, and personal fitness data. We do not claim any ownership rights over your content. By using the Service, you grant us a limited license to store and process your content solely to provide the Service to you.

5. Free and Paid Services

Serkit offers a free tier with core features and a Pro subscription with additional capabilities. Free tier limitations and Pro features are detailed on our Pricing page. Prices are quoted in United States Dollars (USD) and are available on monthly and annual billing terms. Where you pay in another currency, your bank may convert the USD charge using its exchange rate and may apply fees. You may cancel at any time, and access continues until the end of the billing period already paid for.

Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then-current price for your plan, using your saved payment method, until you cancel. You can cancel at any time from Settings using Manage subscription, which opens Stripe’s billing portal; cancelling stops future renewals and your Pro access continues until the end of the period you have already paid for. We will give you notice before any price change takes effect on your plan.

Payments are processed by Stripe. We never receive or store your full card details. Except where a refund is required by consumer law, payments for a completed billing period are non-refundable. Nothing in these Terms limits any statutory rights you have under the consumer protection laws of your country of residence.

Founders. The first 500 completed paid signups receive the $29/year USD rate while continuously subscribed. If you cancel and later resubscribe, you pay the then-available price. Starting checkout reserves a place temporarily; the Founders place is confirmed only after payment completes.

Payment failure. If a payment fails and your subscription is no longer active, Pro access is suspended. Use Manage subscription in Settings to update your payment method and resolve billing issues. Your workout data remains available subject to the free tier limits.

Pro access may also be granted by invitation at our discretion. An invited grant takes no payment and may be time-limited or withdrawn.

6. Coaching

Coaching connects two accounts. Acting as a coach requires a Pro subscription; being coached does not. A connection is formed only when a client accepts an invite, and either party may end it at any time, which immediately revokes the coach’s access to that client’s data.

A coach may view their client’s workout history, send routines and schedules, and leave comments. Coaches are responsible for the guidance they give and for maintaining an appropriate professional relationship with their clients. Serkit is a tool for delivering that guidance and is not a party to any agreement between a coach and a client, nor responsible for the content of a coach’s programming or advice.

7. Planned Features

Some features are described on this site and in the app as planned or “coming soon”. These are statements of intent, not commitments. They are not part of what is offered today, and you should not subscribe on the expectation that a specific planned feature will ship, or ship by a particular date.

8. Health and Safety Disclaimer

Important: Serkit is a fitness tracking tool and does not provide medical advice, diagnosis, or treatment. The AI Coach feature provides guidance based on your workout history but is not a substitute for professional medical advice. Always consult a qualified healthcare professional before beginning any exercise program. You assume all risks associated with your use of the Service and your fitness activities.

9. Acceptable Use

You agree not to use the Service to:

Using Serkit to run your own coaching business is expressly permitted — that is what the coaching feature is for. The restriction above concerns reselling the Service, not charging your own clients for your own coaching.

10. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Serkit and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our written permission.

11. Termination

We may terminate or suspend your access to the Service at our discretion if you violate these Terms or engage in conduct harmful to other users or the Service. You may delete your account at any time through the app settings. Deleting your account cancels your subscription and ends Pro access; it does not keep access until the end of a paid period. Billing records may be retained where legally required. Upon termination, your right to use the Service ceases immediately.

12. Limitation of Liability

To the maximum extent permitted by law, Serkit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the twelve months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless Serkit from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law

These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the courts of New Zealand.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
